This Statement of Privacy applies to Hearistic Partnering and governs data collection and usage to safeguard and to protect your privacy. For the purposes of this Privacy Policy, unless otherwise noted, all references to Hearistic Partnering include Hearistic Partnering, Wade H. Cockburn, PhD, and all website maintained by Hearistic Partnering and/or Wade H. Cockburn, PhD. The Hearistic Partnering website is a news, information, and ecommerce site. By using the Hearistic Partnering website, you consent to the data practices described in this statement

Collection of your Personal Information
Hearistic Partnering may collect personally identifiable information, such as your name. If you purchase Hearistic Partnering’s products and services, we collect billing and credit card information. This information is used to complete the purchase transaction. We may gather additional personal or non-personal information in the future.

Information about your computer hardware and software may be automatically collected by Hearistic Partnering. We will never intentionally disclose any PHI about you or anything you mention in your interactions without your written permission.

Hearistic Partnering will disclose your PHI, without notice, only if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on Hearistic Partnering or the site; (b) protect and defend the rights or property of Hearistic Partnering; and, (c) act under exigent circumstances to protect the personal safety of users of Hearistic Partnering, or the public.

These exception pertain to circumstances mandated by law; we may be required to release PHI to third parties, such as law enforcement for child or elder abuse, or harm to self or others, search warrant, subpoena or court order. Hearistic Partnering may disclose our PHI without your consent or authorization in the following circumstances:

A. Child Abuse – If we know or have reasonable cause to suspect that a child known to me in my coaching capacity has been, or is, in immediate danger of being a mentally or physically abused or neglected child, we must immediately report such knowledge or suspicion to the appropriate authority.

B. Adult and Domestic Abuse – If we believe that an adult is in need of protective services because of abuse or neglect by another person, we must immediately report this belief to the appropriate authorities.

C. Judicial and Administrative Proceedings – If you are involved in a court proceeding and a request is made for information about the professional coaching services we provided you and/or the records thereof, such information is privileged under Texas law, we will not release information without the written authorization of you or your legally appointed representative or a court order. This privilege does not apply when you are being evaluated for a third party or where the evaluation is court ordered. You will be informed in advance if this is the case.

D. Serious Threat to Health or Safety – If we believe disclosure of PHI is necessary to protect you or another individual from a substantial risk of imminent and serious physical injury, we will disclose the PHI to the appropriate individuals.

Security of your Personal Information
Hearistic Partnering secures your personal information from unauthorized access, use or disclosure. When personal information (such as a credit card number) is transmitted to other websites, it is protected through the use of encryption, such as the Secure Sockets Layer (SSL) protocol.

Children Under Thirteen
Hearistic Partnering may collect personally identifiable information from or about children under the age of thirteen. Hearistic Partnering collects this information for Coaching purposes.
